MOUNTAIN COAL COMPANY <br />WEST ELK MINE <br />1997 <br />ANNUAL CERTIFICATION OF <br />SEDIMENTATION POND FW-1 <br />This annual certification is prepared in compliance with Rule 4.05.9(10) and <br />4.05.6(13) of the Regulations of the Colorado Mined Land Reclamation Board for <br />Coal Mining. <br />Phil Schmidt, the certifying engineer, has been working in the engineering <br />field for more than 15 years and has experience in the construction and inspection of <br />Tills, dams, and embankments. He is a registered Professional Engineer in the State <br />of Colorado. <br />Fresh Water Pond FW-1 was constructed to store water which is pumped <br />from the North Fork of the Gunnison River. FW-1 supplies raw water for potable <br />use, dust suppression, fire suppression, and other mine uses. FW-1 was constructed <br />from suitable site materials and is an engineered earthen-fill embankment with <br />3H:1V sideslopes. The pond is lined with asemi-impermeable clay liner. Pond FW- <br />1 specifications can be found in Exhibit 49 of the Mining and Reclamation Plan. <br />Fresh water pond FW-1 was visually inspected for erosion and structural <br />conditions and no problems were observed <br />Phil Schmidt _~~~~~~~ Date <br />1 <br />P.E.
