14. Per Rule 6.4.19, the Division allows for the Applicant to submit as an alternative <br />a Slope Stability Analysis for the mine if agreements with structure owners <br />cannot be reached. If the study indicates that mining at the proposed slopes <br />within the 200-feet of the closest man-made structure will not damage structures <br />within that distance, a lesser setback is allowed. If there would be no damage to <br />the closest structure, it would follow that there would be no damage to structures <br />farther away. The Applicant has had a Slope Stability Analysis prepared and that <br />analysis is attached for your reference. The study indicates that the current <br />setback of 25' will not harm any structures outside of that setback even with a <br />mined slope of 2:1 (horizontal to vertical). Therefore, we request that the <br />Division allow this setback for 3:1 mined slope for the Haldorson mine. Please <br />find the attached study for your reference. <br />15. An Affidavit of Publication from the Montrose Daily Press is attached. The <br />affidavit shows that proper public notice has occurred. <br />16. Proof of proper mailing of notices is contained in the attached envelope labeled <br />"Proof of Mailing". Enclosed in the envelope is a copy of each letter sent to the <br />adjacent property owners, including easement holders, as well as one copy of <br />the notice that accompanied each letter.
