<br />(2Z The moneys annually allocated to llle Itiglter education fund shall be
<br />the amount of the total annual general fund appropriations to the department
<br />of l,;glter education for that fiscal year. Such allocation shall be made, as
<br />moneys become available, on a periodic basis during such fiscal year com-
<br />mencing on July I or the beginning of such fiscal year.
<br />(3) The higher education fund shall be separate from the general fund
<br />and considered a special Cund under section 24-75-201.
<br />(4) Nothing in subsection (1) of this section shall be construed to super-
<br />sede the provisions of section 23-30-106, C.R.S.

<br />state archivist shall establish by rule and regulation such fees as are necessary
<br />to pay for the direct and indirect costs of responding to requests for informa-
<br />tion from non-state agencies, including requests which are processed through
<br />other state agencies. All fees collected shall be transmitted to the state treas-
<br />urer, who shall credit ttte same to the division of state archives and public
<br />records cash fund, which fund is. hereby created. The moneys in the fund
<br />shall be subject to annual appropriation by the general assembly for the direct
<br />and indirect costs of responding to requests for information from non-state
<br />agencies, including requests which are processed tltrouglt other state agencies. ,
<br />All interest derived from the deposit and investment of moneys in the fund
<br />shall be credited to the general fund. In no event shall the state archivist-
