The conditions to the approval are noted below: <br />Stipulation No. O1 <br />THE MAXIMUM ALLOWABLE DISTURBANCE AT ANY ONE TIME IS 108.2 ACRES. <br />Stipulation No. 02 <br />MID-WESTERN FARMS MAY NOT BEGIN MINING UNTIL THEY HAVE SUPPLIED EVIDENCE TO THE <br />COLORADO ATTORNEY GENERAL'S OFFICE OF A REDEEMED TAX CERTIFICATE AND LEGAL <br />OWNERSHIP OF THE SURFACE AND MINERAL RIGHTS OF THE 1470 ACRES OF AFFECTED LAND. <br />The amount of financial warranty set by the Board for this operation is <br />$476,254.00. You must submit a financial warranty in this amount and a performance <br />warranty in order for us to issue a permit. In the event you have requested a <br />financial warranty form, we have enclosed it in this letter. If you have not, <br />please select a type of financial warranty from Rule 7.4. Then contact us so that <br />we can provide you with the appropriate warranty form.
