Dept. o; natural neso~.ccs <br />The following information is in response to your letter of <br />December 1, 1980. <br />Exhibit A: <br />1. The three page legal description defines the metes and bounds <br />measurements of a tract of land owned by Fremont Paving, Inc. The <br />pit itself is located in the extreme southwest corner of that tract <br />as shown in Exhibit C-2 and identified as "Pit Area". <br />2. The pit area to be mined is located in the SE 4 of the SE a of <br />Section 1, T 19 S, R 70 W of the 6th PM in Fremont County. <br />Exhibit B: <br />1. As indicated, the bottom of the mined area will be at the same <br />elevation of the present office building and vehicle shop. I under- <br />stand that is also the bottom of the useful gravel deposit. There- <br />fore, the gravel deposit to be mined is found in an embankment that <br />is approximately 25 feet higher than the finished elevation. <br />2. The surface layer of topsoil is about 7 inches deep (see SCS <br />Exhibit D). Since this is "go-back" cropland, we propose to stock <br />pile the top 10 to 15 inches which has been involved in former <br />farming practices and can not be separated as one might do in the <br />undisturbed site mentioned by SCS. <br />3. This request does not seem reasonable for several reasons. <br />First, the stockpile could not erode away beyond its edges when <br />placed on level land. The suggested sloping only spreads the stocked <br />material over a wider area and would require second and third hand- <br />ling in order to mine the gravel deposit it would then cover. Second, <br />seeding perennial grass is unnecessary and is certainly requiring a <br />standard far higher than the surrounding weed cover on the long <br />abandonded cropland (see the SCS vegetation report). The old stock <br />pile shown in the photograph attached to Exhibit C-3 is protected <br />from wind erosion by natural reseeding that will be duplicated the <br />first year. <br />For these reasons we respectfully request that this item 3 not be <br />imposed as a requirement upon us. However, if this matter is ordered <br />by the Board after hearing our written appeal contained here-in, we <br />will of course comply. <br />
