_~ <br />Adequacy Response <br />Page 3 of 4 <br />While River City Pi[ <br />Permit No. M-2006-084 <br />Response: The applicant hereby commits to seeding the topsoil and overburden <br />stockpiles with the dryland seed mix specified in Table E-3 of Exhibit E, <br />Reclamation Plan. Seeding will take place at the appropriate time of year in <br />order to increase the chance of successful revegetation. Specifically, seeding will <br />take place in either the spring months of May and June and/or the fall months of <br />September and October. <br />9. Please clarify that topsoil will be stored independent of overburden. <br />Response: Topsoil and overburden will be stored independently of each other. <br />As shown on Map C-2, Mining Plan, topsoil berms will be created along the south <br />and north permit boundaries. Overburden from Phase 1 will be used to <br />construct the Staging Area Pad as shown on Map C-2. Overburden from Phases <br />2 and 3 will then be used during concurrent reclamation to create the final <br />reclamation contours. <br />10. Please supply a typical drawing of the fuel farm secondary containment structure. <br />The drawing should include the mil thickness of underlayment materials and berm <br />construction. <br />Response: Per our phone conversation on Apri127, 2007, a detailed description <br />of the secondary containment for the fuel farm will be provided. The secondary <br />containment for the fuel farm will consist of either built-in containment or <br />operator constructed secondary containment. Operator constructed secondary <br />containment will consist of either welded steel tanks or compacted earth berms <br />with 30 mil synthetic liners. This information is also provided in the enclosed <br />revised mine plan. <br />11. It is noted that an asphalt plant will be in use on site. Please provide a plan for <br />weekly clean up of overspill material and designate an area for the temporary disposal <br />of such materials. The temporary site must be above the natural water line of the site. <br />Response: Overspill material will be cleaned up weekly and temporarily stored <br />at the west end of the processing area as shown on Map C-2, Mine Plan Map, <br />which will be above the natural water line. The storage area will be constructed <br />of compacted soil and lined with a 30 mil synthetic line. This process is also <br />described in the enclosed revised Mine Plan. <br />12. Staffnotes a heavy line on Map C-la that is not identified in the Legend. It appeazs <br />to be the 100 yeaz flood plain. Please clazify. <br />Response: As we discussed during our phone conversation on Apri19, 2007, the <br />heavy blue line that crosses the entire map from east to west near the middle of <br />the map is, as you inferred, the 100 year flood plain.
