Cattany <br />Midway Ranches Pro erty Owners Association Division Director <br /> Natural Resource Trustee <br />2454 Waynoka Road <br />Colorado Springs, CO 80915 <br />RE: DRMS File M-006-073; La Farge West, Ines 112 Reclamation Permit <br />Application for the Sundance Sand and Gravel Resource o b~P~r ~ m,. ).p ~}~. ~~ b n ~; ~~ ,,,_ <br />Deaz Mr. Hodges: <br />The Colorado Division of Reclamation, Mining & Safety (CDRMS) thanks you for your <br />letter dated November 4, 2006 stating your concerns regarding the proposed La Fazge <br />Sundance property. <br />The Division appreciates your concerns, but it is uncleaz from your letter whether or not <br />the Midway Ranches Property Owners Association (Midway) desires designation as an <br />official objector of the project. If Midway does intend to be designated as an official <br />objector, and therefore obtain party status, additional steps aze involved. These include, <br />but are not limited to, providing you with additional information concerning your rights <br />and responsibilities as anofficial objector and scheduling this matter for a public hearing <br />before the Mined Land Reclamation Boazd. <br />Please advise the division in writing as to your intentions in this matter as soon as <br />possible. The Division will need to heaz from you in a timely manner to allow us to take <br />the appropriate steps to meet the specified decision date of Jan. 2, 2007 for this project. <br />Therefore, if we do not hear from you in writing stating that you do not wish to be an <br />official objector by December 20, 2006, we will assume that Midway does wish to be <br />designated as an official objector to the project, and will proceed accordingly. <br />Also, please be aware that the Division's thorough review of La Farge's permit <br />application will include a review of anticipated hydrologic impacts, as well as any other <br />environmental impacts that may affect adjacent landowners or parties of interest such as <br />yourselves. If you wish, we can copy you on our review and also forwazd the responses <br />so that you can evaluate potential impacts as they relate to your specific concerns. <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
