Prelimnrary review of <br />tho information received detemlined that the following items must be received before the Division can consider <br />your application as being submitted and technical review can begin: <br />APPLICATION FORM: The application form is improperly notarized. Mr. Ed Dvorak is signing <br />the application as the Area Manager for Western Mobile Southern, Inc. not as the Area Manager for <br />Lafarge. Also, the year of Notarization is not indicated. Please have Ms. Margaret F. Castleberry <br />make the necessary corrections in the notary section on Page 7 of the application form. <br />EXHIBIT N -Source of Legal Right to Enter (Rule 6.4.14): You must provide the source of your <br />legal right to enter and initiate a minnrg operation on the affected land. The Division can only accept a <br />signed notarized statement from Mr. Gary J. Tuttle if he is the legal representative of Mineral Reserves, <br />Inc. Once it is shown that he is the legal representative of Mineral Reserves, Inc., then the signed <br />notarized statement should show that Mineral Reserves, Inc., as the landowner, grants Western Mobile <br />Southern, Inc. the right to enter the property to be mined. <br />EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.191: You must provide information <br />sufficient to demonstrate that the stability of any stmctures located within two hundred (200) feet of the <br />operation or affected land will not be adversely affected. Since Western Mobile Southern, Inc. is <br />removing Mineral Reserves, Inc.'s fence please submit proof that Western Mobile Southern, Inc. and <br />Mineral Reserves, Inc. have an agreeme~ for removing the fence. If there aze any other pemranent <br />man-made stmctures within 200 feet of the affected area the Division cannot accept a statement that the <br />operator will not adversely affect the stability of those stmctures. The Division can accept a signed <br />statement from the operator that they will stay at least 200 feet away from the structures until an <br />agreement or a stability study is submitted to the Division, <br />ADDENDUM 1 -Notice Requirements -Affidavit of Posting Nofice (Signl (Rule 1.6.2(1)(b)): <br />Prior to filing the application, post notices (signs) at the location of the proposed mine site, as required <br />by the Office, of sufficie~ size and number to clearly identify the site as the location of a proposed <br />mining operation giving name, address, and phone number of the Applicant, and stating that (name of <br />Applicant) has applied for a mining permit with the Colorado Mined Land Reclamation Board.
