Box 2187
Fort Collins, Colorado 8052'2
RE: Succession of Gperator
Dear Mr. Hickman:
On October 30, 1990, you submitted a request to change the name of the
operator for twenty-two operations. The name of the permitted operator was
changed in all cases to Western Mobile/IJorth ern. In support of they Request, a
certificate from the Secretary of State was enclosed with each names change.
The certificate certifies that the named companies were merged into Western
Mobil a/Northern.
I have reviewed these name change requests with the Assistant Attorney
General. We both agree that the only way to process these request:. is through
the Succession of Operator process. This process is appropriate as companies
which no longer legally exist are the permittees for each of these twenty-two
sites. It is necessary to transfer the permit from the now defunct companies
to Western Mobile/Northern.
The Succession is also necessary as new Performance warranties, executed by
the new permittee, must be on file. It is my understanding that the financial
warrantor, Western Mobile, Inc., will not change. For your convenience, I
have enclosed Succession of Operator forms and Performance warranties.
