Teller St. <br />Lakewood, CO 80235 <br />Re: E 8th Street Operation, File No. M-2000-082, Receipt of 112 Construction Materials Reclamation <br />Permit Application Package <br />Dear Mr. Refer: <br />On June 20, 2000, the Division of Minerals and Geology received your 112 Construction Materials <br />Reclamation Permit Application package for the E 8th Street Operation, File No. M-2000-082. Preliminary <br />review of the information received determined that the following items must be received before the Division can <br />consider your application as being submitted and technical review can begin: <br />APPLICATION FORM: Please complete the General Location information on Page 2, Item 9 of the <br />enclosed page from your application form. <br />EXHIBIT O -Proof of Mailing of Notices to Counri Commissioners and Soil Conservation <br />District (Rule 6.4.171: Please submit proof of actual delivery or proof of mailing by Certified Mail, <br />return receipt requested, of the Notice of the Application form, to the Board of Supervisors of the West <br />Greeley Soil Conservation District. <br />EXHIBIT S -Permanent Man-Made Structures (Rule 6.4.19): You must provide information <br />sufficient to demonstrate that the stability of any structures located within two hundred (200) feet of the <br />operation or affected land will not be adversely affected. The Division can only accept the following: <br />I J Evidence of an agreement with the owner of the stmcture that will compensate the owner in the <br />event the operation damages the stmcture; or, <br />2.) An engineering evaluation that adequately demonstrates to the Division that the proposed <br />mining and reclamation operations will not result in damage to the structure. This alternative <br />requirement may be met by providing the Division a letter form the entity that owns and/or <br />maintains any utility or irrigation structure or road affirming no anticipated impact to the <br />structure by the proposed operation.; or, <br />3.) You may provide the Division with evidence that a structure is not included within the <br />regulatory definition of a significant, valuable or permanent manmade stmcture. Such <br />
