areas, and closing of the current stockpile nearest the Town of <br />• Somerset on the southern edge of the Somerset Mine property, is in <br />the interest of, and will not be harmful to public health, safety, <br />and welfare, and that such action should be accomplished as quickly <br />as weather, and construction schedules allows, by a date certain to <br />be determined by the Board. <br />6. The applicant has indicated that such relocation will be <br />completed by December 31, 1992. <br />7. There are no substantive, or unmitigable conflicts with <br />County land use policies. <br />8. Testimony was offered by some Somerset residents at the <br />public hearing, at least a portion of the coal dust noted on homes <br />and roads was generated by wind blowing from the coal stockpiled <br />close to Highway 133. The Planning Commission makes no finding as <br />to the severity or magnitude of the dust pollution as a consequence <br />of the activities of this operation, given the relative proximity <br />and magnitude of the other coal operations in this general <br />vicinity. <br />9. This permit solely authorizes the relocation of <br />stockpiles as detailed in the application, and in meetings <br />subsequent to its submittal. Any further relocation, or any <br />additional stockpiles would require further review and action by <br />Gunnison County. <br />• 10. Coal stockpile relocation plan requires relocation of the <br />cemetery access road. The proponent has egret to provide adequate <br />access and year-round maintenance of the road to the cemetery <br />during the life of operation of the mine; that agreement <br />constitutes mitigation on behalf of the proponent. <br />11. The Somerset Mining Co, has the responsibility to <br />maintain the pipeline and pump, tank and other facilities necessary <br />to deliver the water to, the point on the main water line just north <br />of the Denver & Rio Grande Western Railroad Company right of way <br />and being designated "Proposed Meter and Valve Box", as noted in <br />Paragraph #3 on the second page of the water Agreement between <br />Somerset Domestic Waterworks District and Columbia-Geneva Steel <br />Division, United States Steel Corporation. <br />The Gunnison County Planning Commission recommends that LUC # <br />1991-37 be approved as a Minor Impact with the following <br />conditions: <br />1. That the current stockpile be closed down and that area <br />reclaimed for parking facilities, and coal now dumped at the site <br />be dumped at the relocated site, and that such closing, and <br />• 9 <br />
