PART 815 Continued. <br />r1 <br />LJ <br />Section 815.11 General responsiblity of persons conducting coal <br />exploration. <br />(a) Each person who conducts coal exploration which substantially dis- <br />turbs the natural land surface and in which 250 tons or less of coal are <br />removed shall file the notice of intention to explore required under 30 <br />CFR 776.12 and shall comply with Section 815.15 of this Part. <br />Energy Fuels plans to conduct coal exploration which may effect <br />the natural land surface and during which less than 250 tons <br />of coal will be removed. Energy Fuels in Section 776.11 has noti- <br />fied the regulatory authority of its intent to conduct coal <br />exploration and will comply with the provisions of 30 CFR 815.11. <br />(b) Each person who conducts coal exploration which substantially dis- <br />turbs the natural land surface and in which more than 250 tons of coal <br />• are removed in the area described by the written apprcval from the <br />reg~~latory authority, shall comply with the procedures described in the <br />exploration and reclamation operations plan approved under 30 CFR 776.13 <br />and shall comply with Section 815.15 of this Part. <br />As stated in Section 776.12, Energy Fuels will not conduct coal <br />exploration during which more than 250 tons of coal are removed. <br />Section 815.13 Required documents. <br />Each person who conducts coal exploration which substantially disturbs <br />the natural land surface and which removes more than 250 tons of coal <br />shall, while in the exploration area, possess written approval of the <br />regulatory authority fox• the activities granted under 30 CFR 776.12. <br />The written approval shall be available for review by the authorized <br />representative of the regulatory authority or the Office upon request. <br /> <br />B15-2 <br />
