Colorado 80222-1530 <br />Re: Bear Coal Company <br />CDPS Permit No. CO-0044377 <br />Gunnison County <br />Dear Mr. Kubic: <br />The referenced discharge permit authorizes Bear Coal Company to discharge from two <br />outfalls. Outfall 004 provides for the discharge from the sediment pond located at the <br />Bear No. 3 mine site. Outfall 001 provides for mine water discharge. <br />During November 1997, a slide occurred on the southwest corner of the Bear No. 3 Mine <br />surface facilities. Shortly after the slide occurred, about 10 gallons per minute of water <br />began flowing from the east slide scarp. Presumably the water is coming from the old B- <br />Seam workings. The conductivity of the water is in excess of 6,000 umhoslcm which <br />provides further evidence it is discharging from mine workings. <br />The water flows through mud and slide debris prior to the point it can be contained in a <br />pipe or pond. Bear plans to construct a treatment pond for this water to assure the <br />suspended solids are settled before the water is discharged to the river. <br />Since the location of the mine discharge has changed, the location of Outfall 001 will have <br />to be moved about 1,000 feet downstream. The enclosed vicinity map shows the revised <br />location of Outfall 001. Enclosed is a revised facility site sketch for the Bear No. 3 Mine <br />which shows the location of the proposed treatment pond and outfalls 001 and 004. <br />The treatment pond is sized as follows: <br />Pond Surface Area 5800 SF <br />Pond Depth 4 FT <br />Pond Volume 0.109 MG <br />
