Box A <br />Akron, CO 80720 <br />RE: Supplement to Adequacy Review, Washington County, Nickell Pit, <br />File No. M-94-077 <br />Dear Mr. Paynter: <br />Subsequent to mailing out the adequacy letter to you dated August 15, <br />1994, I have received the proof of notice and publication for the above <br />referenced pit. The proof of publication that you sent is in error, in <br />that it is for a Notice of Hearing regarding a landfill. You must <br />provide the Division with the proof of publication for the gravel pit <br />application prior to the August 29, 1994 decision date for the <br />application. <br />Also subsequent to mailing the August 15, 1994 letter, the Division has <br />received correspondence regarding the application from the Army Corps <br />of Engineers and from the Colorado Historical Society. Copies of this <br />correspondence is enclosed. As was surmised in the August 15, 1994 <br />letter, a Department of the Army permit will be required for your <br />proposed operation. The Divsion will place a stipulation on Reclamation <br />Permit approval that all necessary Department of the Army permits be in <br />place prior to breaking ground at the proposed pit. The Colorado <br />Historical Society has indicated that a cultural resource survey is <br />necessary at the site of the proposed pit. The Division will place a <br />stipulation on Reclamation Permit approval that the site be cleared by <br />the Historical Society prior to breaking ground at the proposed pit. <br />You should contact the Historical Society to determine how you should <br />proceed to receive site clearance. <br />If you have any questions, please contact me. <br />Sincerely, <br />~22~`, <br />Allen C.
