Chronic WET Testine-Oulfalls 001. 002 ahd 003 (continued) <br />(z) Request For Relief The permittee may request relief from further invzstigation and testing where the toxicant has not <br />been determined and suitable treatment does not appear possible. !n requesting such relief, the permiltez shall submit <br />material sufficient to establish the following: <br />(i) It has complied with terms and conditions of the permit compliance schedule Cor the PTIrI'IE invzstigalion and <br />other appropriate conditions as may have bzen required by the Division; <br />(ii) During the period of the toxicity incident it has bezn in compliance with all other permit conditions, including, <br />in the case of a POTW, pre-treatment requirzments; <br />(iii) During the period of the toxicity incident it has properly maintained and operated all facilities and systzms of <br />treatment and control; and <br />(iv) Despite the circumstances describzd in paragraphs (i) and (iii) above, thz source and/or cause of toxicity could <br />not be locatzd or rzsolved. <br />If dzemed appropnate by the Division, the permit or thz compliance schedule may be modified to rzvise the oneoine <br />monitoring and toxicity invzsugation roquirzments to avoid an unproduc(ivz expzndilure of the permit(ee's resourczs, <br />provided that the underlying obligation to ehmmate any continuing exceedance of the toxicity limit shall remain. <br />(f) Spontaneous Disappearance If toxicity spontaneously disappears at any lime after a test failure. The permittee shall <br />notify the Division in writing within 14 days of a demonstration of disappearancz of the toxicity. The Division may <br />rzyuire thz permittee to develop and submit additional information which may includz, but is not limited to, the results <br />of additional testing. If no pattern of toxicity is identified or recurring toxicity is not identified, the toxicity incident <br />response is considered closed and normal WET testing shall resume. <br />(g) Toxicity Reopener This permit may be reopened and modified (following proper administrative proczdures) to includz <br />new compliance dates, additional or modified numerical permit limitations, a new or different compliance schedulz, a <br />change in the whole zfFluent toxicity testing protocol, or any other conditions rzlated to the control of toxicants if one or <br />more of the following events occur: <br />(t) Toxiciq• has bzzn dzmonstratzd in the rfFluent and the permit dots not contain a toxicity limitation. <br />(ii) Thz PTI/TIE results indicate that the toxicant (s) represent pollutant(s) that may bz controlled with specific <br />numerical limits, and the Division aerees that the numzncal controls are the most appropriate course of action. <br />Qu) Thz PTI/TlE rzvzals other unique conditions or characteristics which, in thz opinion of the Drviison, justify [hz <br />incorporation of unanticipatzd special conditions in the permit. <br />(n•) The Division may rzopen this permit and impose chronic toxrity limits where chronic toxicity is idzntificJ. <br />C.
