' COL,dRADO DEPART7KENT OF HEALTH, Water Quality Control Division
Rmiamle - Pnge Il, Permit No. CD-0043567
1'1/. PUBLIC NOT/CE COA9MENTS
The permittee submitted comments. They questioned the reduction in total iron limitations from the previous general
permit coverage to this individual permit. This it due to the change from intermittent to continuous discharge, the
limitations are now bared on the water quality standard instead ofjederal new source performance standards.' As a
followup to this explanation, the permittee requested that separate limitations 6e imposed for two conditions: discharge,
ojsrorm runoff only and discharge of combined storm runoff/mine water. This cannot be done without another public
notice of the permit. Because ojthe immediate need to discharge mine water, the permit has stated that they kill
accept the permit ar written for now. The permittee requested elimination of WET testing requirements once all mine
rrarer has been discharged. This would be appropriately handfed through a permit amendment, the permittee hoc been
advised and may submit an amendment request at the appropriate time. The permittee pointed out the contradiction
I~enveen the rationale and the permit regarding when the one-time metair analysis must be performed. The permit hrr.c
lteerr changed to cfarfy that this analysis is required be ore the ftrst discharge ojmine water. Another comment
addressed typographical errors in the stormwater section ojthe rationale (a reference to another mine and the dare for
the first SWMP annual report ro 6e submitted war before the permit becomes effective). Finally, the permittee
questioned the economic reasonableness section's description ojthis facility as "new"; in fact, it is n renurhorizarion n(
discharges previously authorized. This section has been revised. No other comments have been received.
Jan C. Kubic
Decen>l~er 21, 1993
1'/1!. REFERENCES
A.
