Box 535 <br />Somerset, CO 81434 <br />Dear Mr. Cooper: <br />This letter is to confirm Hotchkiss Ranches' understanding of Oxbow Mining's <br />plans to conduct coal exploration drilling and/or mine vent borehole drilling <br />projects at least in part on Hotchkiss Ranches' property in upper Bear Creek. <br />These projects will typically be conducted during the summer months and the <br />projects will include construction (or reconstruction) of access to and pads for the <br />drilling operations. Some sites on BLM and/or US Forest Service lands may also <br />be accessed through Hotchkiss Ranches' property. Site-specific drilling and <br />access plans will be reviewed with Hotchkiss Ranches at least two months prior <br />to the beginning of each year's drilling project. <br />Oxbow Mining will start coal exploration drilling each year as soon as suitable <br />ground conditions exist, but would typically begin in June. If need be to <br />accommodate Hotchkiss Ranches hunting business, Oxbow Mining will complete <br />its drilling operations on Hotchkiss Ranches property by the middle of August <br />each year. <br />Oxbow Mining plans to minimize drill site preparation work and will reclaim the <br />sites to at feast as good a condition as before drilling. At completion of drilling, all <br />existing roads used during the project will be final graded.
