Mark Loye <br />-3- September 8, 1983 <br />Preliminarily, Homestake's representatives have proposed to allow the <br />landslide to achieve equilibrium. They may or may not intend to expeditiously <br />backfill the northern pit. We do not know at this time. I assume that <br />expeditious backfilling miyht accelerate the landslide mass's achieving <br />equilibrium. I believe we should encourage Homestake to complete backfilling <br />of the pit as soon as possible. <br />The principle difficulty in this particular case will involve the <br />determination of the limits of Homestake's responsibility and liability <br />regarding stabilization of the landslide. In my opinion, Homestake, as the <br />operator, has the responsibility of stabilizing the landslide mass. Complete <br />stabilization of the landslide mass may be impractical, as well as <br />geomorphically impossible. The analysis being prepared by Homestake's <br />consultants may shed some light upon this topic. The major task at hand will <br />consist of developing a specific reclamation plan and specific criteria for <br />judging the operator's success. Under any circwnstance, I assume that the <br />stabilization of the landslide mass will require a significant amount of time <br />and a corresponding appropriate increase in the magnitude and time period of <br />the operator's liability.
