Acute ilEf Testirut-Outfalls 001. 002. 005 009. 011 013 015 ~d 016 (continued) <br />(e) Reouest For Relief (continued) <br />(iii) During the period of the toxicity ircident it has properly maintaired and operated <br />all facilities and systems of treatment and control; and <br />(iv) Despite the circumstarces described in paragraphs (i) and (iii) above, the source <br />and/or cause of toxicity could not be located or resolved. <br />If deemed appropriate by the Division, the permit or the coa¢rliarce schedule may be anciified <br />to revise the ongoing monitoring atri toxicity Smrestigatlon requirements to avoid an <br />unproductive expenditure of the permittee's resources, provided that the underlying obll~tion <br />to eliminate arty continuing exceederce of the toxicity limit shall remain. <br />(f) Spontaneouu Disappearance <br />If toxicity spontaneously disappears at any time after a test failure, the permlt[ee shall <br />notify the Division in writing within 14 days of a dearntistration of disappearance of the <br />toxicity. 'Rue Division may require the permittee to develop and svbrnEt additional information <br />uJuich may include, but is not 1Lnited to, the results of additional testing. If m pattern of <br />toxicity is identified or recurring toxicity is not identified, the toxicity incident response <br />is considered closed atd normal {7ET testing shall resume. <br />(g) Toxicity Reopener <br />"ibis permit may be reopened and modified (following proper a3ninistrative proced.rres) to <br />include new cortpliarce dates, additional or modified rnmerical permit limitations, a new or <br />different co~liarce schedule, a change in the whole effluent toxicity testing protocol, or <br />arty other conditions related to the control of toxicants if are or more of the following <br />events occur: <br />(i) Toxicity has been demonstrated in the eCfluient and the permit does rot contain a <br />toxicity limitation. <br />(ii) llie ['f[/1'IE results indicate that the toxicant (s) represent pollutant(s) that may be <br />controlled with specific rnanerlcal limits, and die Division agrees that the numerical <br />controls are the most appropriate course of action. <br />(iii) 'il~e PTI/fIE reveals other unique conditions or characteristics which, in the opinion <br />of the Division, ~ustify the ircorporation of unanticipated special conditions in the <br />permit. <br />C.
