UPPER SOUTH PIRTTE
WRTER CONSERURNGY OISTRfCT
FRfRPt RV, t0. B044R
i,;,~, ~ ., `r-v,
21 May 2007 """'.,~_. `°
Ms. toana Comaniciu
State Engineer's Office
1313 Sherman Street, Room 818
Denver, CO 80203
RE: Ciarificatson of Lease
Dear Ms. Comaniciu:
The Upper South Platte Water Conservancy District (U5PWCD) would like to
clarify its lease of water to Park County dated August 30, 2006, First, this
lease will continue until January 1, 2009 at which time paragraph 2 of the
agreement indicates it is to be renegotiated. Secondly, the lease specifies
that 5 acre-feet will be provided to Park County for genera! purposes, while
another 6 acre-feet is provided for a road construction project (CR77) for the
year 2007. This totals 11 acre-feet. There is another 5 acre-feet that the
Park County could lease in addition to the 11 acre-feet, if it is needed,
pursuant to the provision at the top of the second page of the lease. This 5
acre-feet for genera( use is more than enough to cover the 2 acre-feet of
depletions from the Ansley Ftat Pit. Thus, the Upper South Platte Water
Conservancy District confirms that it will make up to two acre feet per year
available to replace depletions from the pit for water years 2007 and 2008.
Sincerely,
f-~~ ~--
Stephen A.
