i III IIIIIIIIIIIIIIII i <br />999 <br />RESOLUTI Otl $E 77-83 <br />WHEREAS, the SIEVERS RANCH AND DEVELOPMENT COP4PANY has petitioned the <br />Board of County Commissioners of Garfield County, Colorado, for an exemption <br />under C.R.S. (1973) Section 30-23-101 (10) (a) - (d) as amended, and the <br />Subdivision Regulations of Garfield County, Colorado, adopted September 1, <br />1972 and amended April 14, 1975, Sections 1.02.17 (d) and 3.02.01, for the <br />division of an 8.74 acre tract of land from a larger tract of land for the <br />purpose of entering into a lease for the extraction and processing of gravel <br />from said 8.74 acre tract, more particularly described as follows: <br />A tract of land situate in Lots 1 and 6 of Section 13, <br />Township 7 South, Range 89 'rJest of the 6th Principal <br />Meridian being more particularly described as follows: <br />Beginning at a point on the East line of said Section <br />13 whence the Northeast corner of said Section 13 bears <br />N. 00° 49' 00" W. 817.28 feet; thence S. Ono 49' 00" W. <br />518.32 feet along said East line of Section 13; thence <br />N. 62° 43' 30" W. 824.08 feet; thence N. Ol° 27' 35" E. <br />515.47 feet; thence S. 620 43' 30" E. 817.61 feet to the <br />point of beginninn; containi,ig 8.74 acres, more or less. <br />WHEREAS, Petitioner has previously been granted approval by the Board of <br />County Commissioners of Garfield County of a special use permit allowing such <br />extraction and processing of gravel; and, <br />WHEREAS, Petitioner has demonstrated to the satisfaction of the Board of <br />Garfield County that said exemption will not create any residential uses on <br />said 8.74 acre tract; <br />NOW THEREFORE, upon motion of Ala vCM l er~~S~ seconded <br />by ~~~Q~c~~~ UG'~ and carried, said 8.74 acre tract of land is hereby <br />exempted from such definition and transfer of said tract may be made for the <br />purpose of entering into a lease for the extraction and processing of gravel, <br />and further said exemption will not create any residential use of said 8.74 <br />acre tract, as is more fully described above.
