(Section 37-92-103, CRS (1973),(9)). Running Cheek Ranch
Company should devise an augmentation plan to replace the out-ofLpriority
consumptive use associated with pond evaporation and other out-of-priority
consumptive uses of water. We advise Running Creek Ranch Compan~+ to hire a
water consultant to develop the augmentation plan.
Since the existing pond will be eventually enlarged from 7 to 16 acres,
Running Creek Ranch Company will have to augment for only the 9 Gres of
increased surface area created by the mining. Also, since Runni Creek Ranch
Company plans to pump water from the existing pond for dust supp ession and
other water requirements of the mining plan, they will also have to augment
for this amount of water being used.
In summary, we cannot recommend approval of this application unt l the issues
discussed in this letter are addressed. Further, we will order unning Creek
Ranch Company to cease operations if our Water Commissioner dete fines grourrl
water is being exposed or pumped out without a well permit or wa er is being
diverted illegally.
I-IDS/JCM:ma/4279
cc: Jim Clark, Div.
