This response will address each item from <br />your letter in order. Also included is a response to your letter of October 3, 2000, regazding the <br />pre-operational inspection. <br />NOTICES: Please find enclosed proof of notifying Ed Pino and Ernest Shater, laid <br />owners, of this Permit Application. Also, is a copy of the final published public notice in the <br />Huerfano World newspaper. We will forward the affidavit of publication as soon as we get it. <br />EXHIBIT C: Rule 6.4.3- The "Permit Boundary Traverse" on all maps has been <br />corrected. [t now corresponds to Exhibit A. <br />EXHIBIT C: Rule 6.4.3(a) -The ownership "Key" has been changed to correctly <br />represent the property owners. <br />EXHIBIT C: Rule 6.4.3(8) -The owners of the permanent mamnade structures have been <br />added to the map. Alsu, a power line that runs parallel to the access road has been added. Please <br />see revised Exhibit C maps which are enclosed. <br />EXHIBIT D: Rule 6.4.4(e) -The applicant agrees that there will be no more than l0 acres <br />of open pit and no more than 1000 lineal fee[ of vertical, unreduced highwall existing at any <br />time. Overburden and topsoil will be stripped prior to excavating the gravel deposit. The <br />overburden will be stockpiled along two margins of the area to be excavated and the topsoil on <br />the third. The remaining pit margin will be ramped down into the pit. One mining has reached <br />the 10 acre limit, mining will be down to a 3H:1 V slope to avoid reducing the highwall by <br />backtilling. <br /> <br />"Your Brand of People" <br />
