Response to Jerald M. Young Page 3
Delta Paving Gravel Pit
File No. M-98-105
2/23/99
and Rules do not appear to address traffic safety issues. Therefore, this issue does not
appear to be within DMG jurisdiction. Traffic safety issues may be appropriately addressed
by the Delta County governing authority, or possibly by the Colorado Department of
Transportation.
Thank you for considering my concerns in this maifer.
The Act and Rules provide opportunity for public participation throughout the permitting
process. The Board and DMG will consider all comments, submitted in accordance with
the Act and Rules, in its review process and final permit consideration. However, the Act
and Rules states that the Board or DMG shall not deny a permit application which satisfies
the minimum requirements of the Act and which is not contrary to local, state, and federal
laws or regulations.
Thank you for your comments. Please contact me at the DMG Durango Office, 484 Turner
Drive, Building F, Suite 101, Durango, CO 81301, phone (970) 247-5469, or by FAX at
(9701 247-5104, if you have any questions.
Sincerely,
Wallace H.
