<br />all withdrawals of underground water pursuant to this plan and <br />will install such measuring devices as required to do so. <br />Records of diversions and releases will be supplied as requested <br />to the Division Engineer. <br />1. Termination of Plan: Applicant requests that it <br />be allowed to elect, in its sole discretion, to terminate this <br />plan for augmentation should mining operations cease. Applicant <br />will provide notice to the Court, the Division Engineer, and all <br />parties to this action that out-of-priority diversions pursuant <br />to the plan for augmentation have terminated. <br />7. Names and Addresses of Owners of Land on Which <br />structures are Located: The names and addresses of owners of <br />land on which the structures identified in this application are <br />located are set forth on the attached Exhibit D. <br />WHEREFORE, Applicant prays for an order of this Court: <br />a. Granting the application herein and approving the <br />proposed amendment to the plan for augmentation set out in the <br />Original Decree; <br />b. Amending the listings of Ditch Rights, Storage Rights, <br />and Underground Rights on Exhibit A to the original Decree to <br />include the structures described in this application; <br />c. Changing the amount of historical consumptive use for <br />the water rights described in paragraph 3 of this application to <br />storage for later year-round use in mining, reclamation, <br />irrigation, electrical generation, fish propagation, and all <br />other beneficial uses, in accordance with paragraph 14.A of the <br />Original Decree; <br />d. Allowing use of the water rights described in <br />paragraph 2 of this application as alternate points of diversion <br />for the Ditch Rights, in accordance with paragraph 14.B of the <br />original Decree; <br />.e. Allowing storage of the Ditch Rights in any or all of <br />the Storage Rights, in accordance with paragraphs 14.C and 14.D <br />of the Original Decree; <br />f. Clarifying the Original Decree to provide for <br />augmentation of depletions resulting from out-of-priority <br />diversions from the Underground Rights with releases of stored <br />water in the Storage Rights; <br />g. Clarifying the Original Decree to allow for out-of- <br />priority storage of water in the Storage Rights, so long as such <br />diversions to storage are augmented pursuant to this plan. <br />-15- <br /> <br />
