<br />Source: Foidel Creek <br />Appropriation date: April 30, 1980. <br />Amount: 11.2 acre feet. <br />Use: Irrigation, reclamation, recreation, fish <br />propagation, aesthetic, domestic, municipal, industrial, <br />commercial, mining and mineral processing, suppression of <br />fugitive dust, electrical generation, fire prevention, stock <br />watering, and all other beneficial uses including exchange, <br />substitution, replacement, and augmentation. <br />Historical Use. <br />a. Rawlinson Ditch: This ditch was decreed in 1891 <br />for 1.5 c.f.s. to irrigate 90 acres of land. Water has <br />historically been diverted under the Rawlinson Ditch water right <br />and used for the irrigation of 90 acres located primarily in <br />Section 24, Township 5 North, Range 87 West, 6th P.M. <br />A lysimeter study conducted during the period of <br />1979-1981 calculated historical consumptive use for pasture <br />grasses in the Trout Creek watershed at 1.45 acre feet per acre <br />of land irrigated. This consumptive use calculation was used in <br />the original Decree. Applicant asserts that 1.45 acre feet per <br />acre is a reasonable and conservative estimate of the amount of <br />consumptive use associated with the Rawlinson Ditch water right. <br />Accordingly, a total of 130.5 acre feet of consumptive use is <br />associated with the Rawlinson Ditch for the 90 acres of land <br />historically irrigated. <br />b. Eckman Park Ditch Nos. 1-5: These water rights <br />were originally decreed for irrigation purposes. Until the <br />1970's, the water rights were used for irrigation purposes. The <br />historical consumptive use has been quantified at 80.33 acre feet <br />for the five ditches collectively in Case Nos. W-1186-77 and <br />79CW132, Water Division No. 6. <br />6. Statement of Amendment to Plan for Augmentation <br />Including Exchanges: <br />a. Description of Water Uses: Applicant is a <br />Colorado corporation, primarily engaged in mining low-sulfur coal <br />in Routt County, Colorado. Applicant also engages in stock <br />watering and irrigation in connection with its ranching <br />operations. The particular mine involved in the present <br />Application for Approval of Amendment to Plan for Augmentation is <br />known as the Foidel Creek Mine and is located in Townships 3, 4, <br />5, and 6 North, Ranges 85, 86, and 87 West, 6th P.M. The Foidel <br />Creek Mine is in the watersheds of Foidel, Trout, Middle, and <br />-12- <br />
