Per Rule 1.7(2)(a) these comments are considered timely in the application process. Staff faxed the <br />comments to Energy Fuels immediately upon receipt for their review and records. <br />The Division as part of the adequacy review is requesting that Energy Fuels formally respond to the INFORM letter. <br />Energy Fuels should send the response directly to INFORM and copy the Division. As noted in the Division letter to <br />INFORM there are some issues brought up which are normally reviewed and some that are non jurisdictional. <br />Currently the Division's hydrologist, geo-chemist and engineer are reviewing the application. Staff has requested that <br />their comments be submitted by November 1 or as close thereafter as possible. Once all the staff comments have been <br />submitted an adequacy letter will be forthcoming as soon as possible. <br />Sincc~erely, <br />G.
