EXHIBIT <br />-, ~ ~ S <br />JEFFERSON COUNTY DISTRICT COURT <br />Court Address: <br />100 Jefferson County Parkway <br />Golden, Colorado 80401 <br />THE BOARD OF COUNTY COMMISSIONERS OF Case Number: 03 CV 69 <br />GILPIN COUNTY acting as the Gilpin County Board Div.: G courtroom: <br />of Health, <br />Plaintiff-Appellee, <br />v. <br />PHILLIP WOLF and KATHLEEN WOLF <br />Defend ants-Appellants. <br />ORDER <br />Tt appears this matter comes befoce the Court upon Defendants-Appellants' <br />Complaint for Judicial Review pursuant to § 13-6-310 and § 13-6-311 of the Colorado <br />Revised Statutes. <br />INTRODUCTION <br />On April 2l, 2003, the County of Gilpin ("Plaintiff') filed a complaint in county <br />court against Phillip and Kathleen Wolf ("Defendants") to assess civil penalties for <br />zoning violations under C.R.S. §30-28-124.5. On May 1, 2003, Defendants filed an <br />answer with numerous exhibits attached. Trial to the county court was held on July 28, <br />2003. At the commencement of trial, the Defendants, appearing pro se, handed the court <br />a notice of special appeazance and a notice challenging personal and subject matter <br />jurisdictions. The court reviewed the documents and found the court had jurisdiction. <br />The Defendants then introduced numerous exhibits into evidence and questioned <br />witnesses. After all the evidence had been presented, the court found by a preponderance <br />of the evidence the Defendants violated the Gilpin County zoning requirements and <br />assessed civil penalties of $250 per violation. <br />On August 5, 2003, the Defendants filed a motion for a new trial. The county <br />court denied the motion on August 25, 2003. On September 5, 2003, the Defendants <br />filed a notice of appeal and submitted a brief. The Plaintiff also asks for attorney's fees <br />associated with this appeal. <br />I. STANDARD OF REVIEW <br />
