Modification Sua easion or Revocation of Permits B the Division <br />Continued <br />(i) Ia the case of termination, tha permittee notifies the <br />Dlvieion of its intent to terminate the permit 90 days <br />prior to the desired datn of termination; <br />(11) Ia the case of termination, the permittee has ceased any <br />and all discharges to state eaters and demonstrates co the <br />Division there is no probability of further uncontrolled <br />discharge(s) which may affect eaters of the State. <br />(iii) The Eavironmeatal Protection Agency has been notified of <br />the proposed codification or termination and doe:9 nor <br />object is writing vrithia thirty (30) days of rec~aipt of <br />notification; <br />(iv) Tha Division finds that the parmittee has shown :reasonable <br />grounds consistent with the Federal and State statutes and <br />regulations for such modification, amendment or termination; <br />(v) Fee requirements of Section 6.16.0 of State Discharge <br />Permit Systea Regulations have been met; and <br />(vi) Requirements of public notice have been met. <br />6. Oil•aad Hazardous Substance Liability <br />Nothing is this permit shall be construed to preclude the i:istitution <br />of any legal action or relieve the permittee from nay <br />responsibilities, liabilities, or penalties to which the permittee is <br />or may he suhject to under Section 311 <011 and Hazardous Substance <br />Liability) of the Clean Water Act. <br />7. State Laws <br />Nothing is this permit shall be construed to preclude the ixistitution <br />of any legal action or relieve the permittee from any <br />responsibilities, liabilities, or penalties established pur:iuaat to <br />nay applicable State law or regulation under authority graat:ed by <br />Section 510 of the Clean Water Act. <br />8.
