5. Modification Sua easion or Revocation of Permits B the Division

(i) Ia the case of termination, tha permittee notifies the
Dlvieion of its intent to terminate the permit 90 days
prior to the desired datn of termination;
(11) Ia the case of termination, the permittee has ceased any
and all discharges to state eaters and demonstrates co the
Division there is no probability of further uncontrolled
discharge(s) which may affect eaters of the State.
(iii) The Eavironmeatal Protection Agency has been notified of
the proposed codification or termination and doe:9 nor
object is writing vrithia thirty (30) days of rec~aipt of
notification;
(iv) Tha Division finds that the parmittee has shown :reasonable
grounds consistent with the Federal and State statutes and
regulations for such modification, amendment or termination;
(v) Fee requirements of Section 6.16.0 of State Discharge
Permit Systea Regulations have been met; and
(vi) Requirements of public notice have been met.
6. Oil•aad Hazardous Substance Liability
Nothing is this permit shall be construed to preclude the i:istitution
of any legal action or relieve the permittee from nay
responsibilities, liabilities, or penalties to which the permittee is
or may he suhject to under Section 311 <011 and Hazardous Substance
Liability) of the Clean Water Act.
7. State Laws
Nothing is this permit shall be construed to preclude the ixistitution
of any legal action or relieve the permittee from any
responsibilities, liabilities, or penalties established pur:iuaat to
nay applicable State law or regulation under authority graat:ed by
Section 510 of the Clean Water Act.
8. Permit Violations
Failure to comply with any terms and/or conditions of this F:ermic
shall be a vialacioa of this permit.
