l9. Issue 7(D), Map of Surface and Groundwater Resources on Affected and Adjacent <br />Lands (Rule 6.4.7). As staled in the Division's Rationale or as provided in testimony <br />during the hearing, the Applicant has adequately and accurately identified all surface and <br />groundwater resources on affected and adjacent lands through submission of Exhibits B, <br />C-1, C-2A, C-2B and C-2C. There are no known perennial streams within the boundaries <br />of the proposed affected lands. A portion of Cottonwood Creek lies within the proposed <br />permit boundaries, but it is greater than 3,000 fee[ from the proposed affected land and is <br />not expected to be impacted by quarry operations. <br />20. The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements of Rule 6.4.7. <br />21. Issue 7(E), Management of Water to Protect Against Surface Water Pollution (Rule <br />6.4.7(2)(c)). The Applicant has provided a comprehensive sediment and erosion control <br />plan for the site which addresses management of stormwatcr runoff, and minimizes the <br />potential for impacts to surface and groundwater quality and supply. The Applicant will <br />provide "As-Built Certifcations" from a certified registered professional engineer within <br />60 days of completing all hydraulic structures and will verify that all such structures have <br />been installed properly based on designs provided in the mining and reclamation permit. <br />The Applicant has also committed to conducting an annual survey and maintenance of all <br />drainage structures. As stated in the Division's Rationale and as noted during the <br />hearing, the Applicant has committed to securing a Colorado Discharge Permit <br />SystemJNational Pollution Dischazgc Elimination System permit ("Discharge Permit") <br />from the Colorado Water Quality Control Commission prior to any offsite discharge. <br />The Applicant has also provided an adequate monitoring program to ensure protection of <br />MMRR Hoard Order, M-2004-067 t 0 <br />2680 <br />
