Mine <br />2004 SPCC <br />• 1.0 REGULATORY BACKGROUND AND IMPLEMENTATION DEADLINE <br />EPA issued a final rule on July 17th, 2002 that amended regulations promulgated under the <br />authority of the Federal Water Pollution Control Act (Clean Water Act) at 40 CFR Part 112 <br />entitled "Oil Pollution Prevention and Response: Non-Transportation Related Onshore and <br />Offshore Facilities." This rule addresses requirements for Spill Prevention, Control and <br />Countermeasure Plans (SPCC Plans). The final SPCC rule, which became effective on August <br />]6, 2002, addresses revisions proposed by EPA in 1991, 1993 and 1997. The Agency <br />subsequently extended the compliance deadline for revision and professional engineer (PE) <br />certification of SPCC plans to August 17, 2005. The Plans must be implemented by February 18, <br />2006. The approach of Trapper Mining Inc. (Trapper) is to be in compliance by the regulatory <br />deadlines. <br />1.1 DEFINITIONS <br />What is oil? From § 112.2 "oil means oil of any kind or in any form, including... petroleum, fuel <br />• oil, sludge, synthetic oils, mineral oils, oil refuse, or oil mixed with wastes other than dredged <br />spoil." <br />What is a SPCC Plan? From §112.2 a SPCC plan is: "the document required by §112.3 that <br />details the equipment, workforce, procedures, and steps to prevent, control, and provide adequate <br />countermeasures to a discharge." <br />What is a facility? From § 112.2 "facility means any mobile or fixed onshore or offshore <br />building, structure, installation, equipment, pipe, or pipeline (other than a vessel or a public <br />vessel) used in oil well drilling operations...oil storage, oil gathering, oil processing, oil transfer, <br />oil distribution, and waste treatment, or in which oil is used.... The boundaries of a facility <br />depend on several site-specific factors, including, but not limited to, the ownership or operation <br />of buildings, structures, and equipment on the same site and the types of activity at the site." <br />What is a bulk storage container? From §112.2 "any container used to store oil. These <br />containers are used for purposes including, but not limited to, the storage of oil prior to use, <br />while being used, or prior to further distribution in commerce." From §112.1(d)(2)(ii) "only <br />• containers of oil with a capacity of 55 gallons or greater are counted" towazd the 1320-gallon <br />
