The specific lecaticn is: <br />T. 35 N., ~. 17 ;•1., Sec. 12: S1/25E1/S, Sec. 13: Dili2NE1/S, <br />Montezuma County just west of the junction of County Load F and <br />County Road 21. The mineral owner of the property is Daren Stone. <br />BLi? is the surface cw-ner. It i_ approximately 160 acres in size. <br />This parcel :vas homesteaded at an earlier date.. ._.: surface of <br />this land was recor_veyed to the United States cn ~a-:uzry 27, 195G. <br />All minerals of every ,kind lying in, under er upon the property <br />were reserved to the private owner. On April 25, 1997, Mr. Stone <br />applied for a land use permit to explore for gravel on this parcel. <br />+r;ith further revie~:: of the case by BEM, we concluded t::at there was <br />no a+;thorization recsired for DIr. Stone's exercise of his property <br />right. S~'e sent a letter on Diay 27, 1997 reccgnizir_g his right and <br />informing him of cultural resources on or near the s..rfaee. <br />Although the ensuing exploration v:ork :vas monitored by az <br />archeologist, some surface artifacts were disturbed. ?urther <br />testing and possible data recovery is required to assess the <br />significance of the site. No damage to subsurface features of the <br />site occurred from this initial mineral work. <br />This mining activity- fails under the State of Colorado, Division of <br />Mining and GeoloSy permit process. tie have participated as any <br />surface o+.vner with subservient rights would with tY:e state. :ye <br />k:ave recommended mitigation meas+.:res for the surface inc'_uding data <br />recovery and further testing cf the cultural resources. Mr. Stone <br />has indicated his intention to abide b~• cur recommeacations and <br />participate with us in the recovery of the cultural resources. <br />This property is imsediately adjacent to an inactive gravel pit, <br />situated furtl-,er ..,rest, which has not bae.^. operated for several <br />years. It belongs to another owner (surface and mineral) who has <br />apparently done no reclamation. cf any sort. Tn+e caz certainly <br />understand the concern o'_ the neighboring landowners.
