E. <br />State Engineer <br />RECEIVED <br />MAY 3 ~,. 2001 <br />Division ota d Safety n' <br />Mining <br />We have received your letter dated March 28, 2007 requesting approval of a substitute <br />water supply plan for the above referenced plan on behalf of ACA Products, Inc. (ACA). The <br />request has been reviewed pursuant to 37-92-308(5) and you have paid the required $300 fee. <br />Notice has been provided to those on the notification list and comments have been received <br />from Mr. John M. Dingess on behalf of the City of Aurora within the 30-day comment period. <br />PLAN OPERATION <br />This proposal is to run a gravel washing operation for 6 weeks beginning in June and <br />extending through the middle of July. You proposed to divert up to 1 cfs through the Templeton <br />Ditch off of Halfmoon Creek to fill a sediment pond and to replace water lost through <br />evaporation and aggregate export. No mining will occur at the site. <br />DEPLETIONS <br />You have estimated that the initial fill of the pond will require up to approximately 10 ac- <br />ft, approximately 2 ac-ft for evaporation, and approximately 0.6 ac-ft for water lost in 20,000 <br />tons of product. The total anticipated depletions are approximately 13 ac-ft. The evaporation <br />appears to be evenly split for the months of June and July. <br />REPLACEMENT <br />ACA has leased a total of 90 ac-ft from Pueblo Board of Water Works. This amount of <br />water is also intended to replace transit losses and seepage from the pond. This water is <br />stored in Turquoise, Twin Lakes, Clear Creek, and Pueblo Reservoirs. Pueblo will deliver the <br />type of water legally appropriate for the intended use and will attempt to deliver water from the <br />point nearest the intended use to minimize transit loss. <br />
