Linden attached for your reference (Exhibit 1), this <br />letter will serve as a Petition for Party Status filed on behalf of our client, Jarle Halsnes, in the above <br />referenced matter pursuant to 2 C.C.R. 407-4, Rules 2.7.1 and 2.7.2. This Petition is based upon the <br />apparent failure of the referenced permit applicant ("Lafarge") to follow required public notification <br />procedures established in accordance with C.R.S. §34-32.5-113 for permit applications under the <br />Construction Materials Rules and Regulations ("Rules") of the Mined Land Reclamation Boazd ("NLRB") <br />-Rule 6.1 PUBLIC NOTICE PROCEDURES, and failure of the system utilized by the Colorado Division <br />of Minerals and Geology (the "Division") to ensure public notification of permit applications and the <br />permit status with respect to all potential and existing mine operations in every county through iu Internet <br />website, http://mining.state.co.us. <br />As a result of the failure to be notified timely as discussed below, Mr. Halsnes missed, by one day, <br />the deadline to file his objection to the referenced permit application ("Reclamation Permit Application"). <br />Consequently, in accordance with the 20-day deadline in Rule 1.7.4, the Division would not accept his <br />request for status as a party objector or his objection to the Reclamation Permit Application.
