e O O <br />5. Pursuant to the requirements of the permit, Colorado Yampa <br />sampled and analyzed the effluent at outfall 007. Colorado Yampa submitted <br />reports to the Division on the levels of pollutants in the effluent which <br />included the following data: <br />Reporting 30-day Average Concentration (in milligrams <br />Period per liter "mg/1") of dissolved manganese <br />November, 1986 0.496 <br />December, 1986 1.03 <br />January, 1987 1.03 <br />February, 1987 0.870 <br />March, 1987 0.592 <br />April, 1987 1.29 <br />6. In reports submitted by Colorado Yampa to the Division, the <br />reported 30-day average concentration total recoverable manganese was 1.09 <br />mg/1 for December, 1986 and 1.49 mg/1 for April, 1987. <br />NOTICE OF VIOLATION <br />You are hereby notified that the facts stated above constitute <br />violations of Part I.A.4. in the permit, as set forth below: <br />1. The 30-day average concentrations for dissolved manganese for <br />November and December, 1986 and January, February, March and April, 1987 <br />exceeded the 30-day average allowed by the permit of 0.174 mg/1 based on a <br />minimum of three samples collected on separate weeks within a 30-day period. <br />2. The 30-day average concentrations for total recoverable <br />manganese for December, 1986 and April, 1987 exceeded the 30-day average <br />allowed by the permit of 1.0 mg/1 based on a minimum of three samples <br />collected on separate weeks within a 30-day period. <br />CEASE AND DESIST ORDER <br />Based upon the foregoing findings of fact and notice of violation, <br />and pursuant to the provisions of 25-8-605, C.R.S. (1982), I hereby order you <br />to: <br />1. immediately take whatever measures necessary to cease and desist <br />violating the permit and the Water Quality Control Act, 25-8-101 to 703, <br />C.R.S. (1982 and 1985 supp.) and regulations promulgated thereto; <br />-2- <br />
