Attorney's Office E1 Paeo County, Colorado Dear Mr. Barrys We have recently received 30 applications for seining and reclamation permits. for the gravel plte operated by E1 Peso County. Tice applications are apparently the county's attempts at compliance +oith 34-32-101 C.R.S. 1913 as emended (the Colorado tuned Land Reclamation Act). Unfortunately, the applications are still incomplete, and inadequate. The E1 Paeo applications wire reviewed by several board members at the Aecertber 21 board meeting, and the board has specifically requestod that you ba advised of the inedggaite nature of the applications. The particular deficiencies of the recently anbnittad applications are itemised belor. (1) No application Lase ware submitted. On each application it is noted that the application fee ie "unknown due to weather con- ditione." (2) The exhibits were not submitted, or those that wnra era not proper. For exe®ple, the description in your purchase orders will not suffice ae a legal description of the property. (3) No acreage figures raze submitted for each gravel pit. All the applications note that the affected acreage "could depend on acts of God." The general practice ie to simply estimate the total acreage to be affected by the operation. (4) The proposed future land use has not been identified for aey of the gravel pits. Each application notes that "the landowner has not informed E1 Paao County." The county should simply work out an acceptable land use for the reclaimed land with the landowner. In most canes, the future use ie simply gracing land or dry land farming. The purpose of this requirement should be obvious -- the reclamation plan should be designed with the future land use in mind. (» Only a general map seas submitted with the applications.
