Review of Ibis i~ormatioa determined that <br />the notarized statement from Mr. Jon File, Managing Partner for Farfrumwurkirt, I,LP does not meet the requirements for <br />Exhibit S, Permanent Man-made Strtrctures (Rote 6.4.19) below: <br />EXAiRiT C - PnrnsnnrM Mnn_Mnrin CfnEefnraa (Kola 6.d_'~; YOll mUSt provide lllfotnlatiDn SI1t17Clent t0 <br />demonstrate that the stability of an3' stnr7zures located within two hundred (200) feet of the operation or affected land <br />will oat be adverse}y affected. Please provide either: <br />a notarized agreement between the appficant and the person(s) having as interest in the stnrcture, that the <br />applicant is to provide compensation for any damage to the structure; or <br />where such as agreement can not be reached, the applicant shall provide an appropriate engineering evaluation <br />that demonstrates that such structure shall not be damaged by activities occurring az the mining operation. <br />where such structure is a Iltility, the applicant may supply a notarized letter, on utility letterhead, from the <br />owner(s) of the utility that the mining and reclamation activities, as proposed, will have "no negative effect' on their <br />utility. <br />the Division will also accept a signed statement from Farfiumwt7rloin, I.LP stating that they will stay ai least <br />200 feet away from the stnrctures until agreements or an appropriate engineering evaluation is submitted to the <br />Division. <br />You have tlilrty (30) days from the above date to submit all necessary documents that the Office needs for an application to be <br />considered filed It; at the end of the sixty day period, the applicaton has not been determined to be filed with the Office, the <br />Office shall deny the application and terminate the application file. <br />This letter shall not be construed to mean that there are no other technical deficiencies in your application.
