Simpson, P.E. <br />State Engineer <br />Re: "Substitute Water Supply Plan, Nissen Pit (DMG #M-2003-001) ~: <br />u ~~~ `Cl <br />Section 12, T5N, R65W, 6th P.M. <br />Water Division 1, Water District 2, Weld County <br />Dear Mr. Leaf: <br />This letter is in response to your application of December 19, 2002 for a substitute water <br />supply plan for Nissen Pit Site. The required fee of $1,343 for the substitute water supply plan has <br />been submitted. <br />The anticipated net depletion for this plan is 45.28 acre-feet per year. There are 4.2 acres of <br />water surface exposed after December 31, 1980 (4 acres silt pond and 0.2 acres of dewatering <br />trenches to accommodate the construction of a slurry wall). The mined area will be lined with a <br />slurry wall in late 2003 or early 2004. Mining will not commence until the slurry wall has been <br />constructed and approved by the Division Engineer. Therefore, if the dewatering stops, no more <br />than 4.2 acres will be exposed at the site. According to the information submitted, no water surface <br />was exposed within the reclamation permit boundary prior to January 1, 1981. <br />You have provided a monthly breakdown of the annual depletions consisting of 11.93 acre- <br />feet ofevaporative loss, 14.7 acre-feet of water lost with mining of up to 500,000 tons of aggregate <br />per year, 3.31 acre-feet of losses from water used for dust control and 15.34 acre-feet of water used <br />in concrete production. The water used in the concrete botching and dust control is proposed to be <br />withdrawn from the well permit number 5115-F. A well permit application to use an existing well for <br />the above purpose was submitted to the State Engineer's Office on February 24, 2003 (receipt no. <br />506240). No phreatophyte credit has been applied to this plan. <br />The proposed source of replacement water for this pit is 0.6 shares of Lower Latham Ditch <br />and 2.25 shares of Lower Latham Reservoir. There are 200 outstanding shares in the Lower Latham <br />Ditch and 156 outstanding shares in the Lower Latham Reservoir. The 0.6 share of ditch water is a <br />portion of the 2.5 shares leased by Hall-Irwin in the Lower Latham Ditch from the Water Resource, <br />LLC. The 2.5 shares of ditch water and the 2.25 shares of reservoir water were historically used to <br />irrigate 120 acres on the Nissen farm. In addition to the ditch water and the reservoir water, well <br />permit nos. 5115-F and 13255-R were used as supplemental supply water on the 120 acres. The <br />0.6 share of the Lower Latham Ditch and 2.25 shares of the Lower Latham Reservoirwill be used to <br />cover the mining depletions attributed to the Nissen mine via direct release to the South Platte River. <br />The monthly depletions and replacement requirements are found on the attached table. <br />October 15. 2003 <br />
