Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has begun the review process for the above referenced 112c <br />application. As a matter of circumstance, the pre-operational inspection was conducted on November 20t", <br />2003. No issues were noted directly associated with that inspection except for hazardous materials storage <br />issues that will be addressed below. <br />Please respond to staff's query concerning the clarification or addition to the following issues: <br />11 DMG received a response from the Office of State Engineer (OSE) concerning 2 issues. (Copy <br />enclosed) Please supply documentation to staff that the applicant has addressed the noted concerns <br />with the OSE. <br />21 Per Rule 6.4.4(1), please specify whether or not explosives will be used on site. <br />3) Per conditions noted during the pre-operational inspection and noted as a problem for the existing <br />permit, please supply a secondary containment plan for the storage of hazardous materials on site <br />and the disposal of potential hazardous waste. Fuel and other petroleum products were observed <br />uncontained and exposed to the elements and bare earth. <br />4) Under 6.4.5(e)(iii)(1), Please specify the seed mix to be used in topsoil stockpile stabilization <br />measures. Staff recommends the use of the same mix.proposed for final reclamation as it will help <br />establish a seed bank in the stored soils and may help in revegetation success later on. <br />51 In reference to the proposed seed mix. Staff has no issues with the grass species identified but <br />would request that more shrubs be included in the mix. A small amount of rabbitbrush and sage <br />would help augment the natural reintroduction of these species into the disturbed areas. With <br />current precipitation patterns, staff has observed a better viability from shrubs as opposed to <br />grasses. <br />These reviewed issues do not imply that all other requirements are met. Further adequacy review will be <br />undertaken on this application as relevant information is supplied and analyzed.
