Relationship to Areas Designated unsuitable for Mining. <br />Applicant is unaware, and has no information, that the pro- <br />posed permit area is within an area designated unsuitable for <br />mining under either Rule 7 or 30 C.F.S. 764 and 765, or is <br />subject to a study for designation in an administrative pro- <br />ceeding under Rule 7 or 30 C.F.R. 764 and 765. <br />5. Permit Term Information. It is estimated that six <br />months to one year will be required to complete excavation <br />for benches, construction of outside mine facilities and <br />auxiliary buildings, installation of electric power and <br />access roads, and preparation of the mine portals for opera- <br />tion. Subsequent to this period of time, an additional <br />ninety days to six months will be required to advance the <br />portal entries to a stage where underground coal extraction <br />can be commenced. It is estimated that an additional. thirty <br />(30) years will be required to recover the coal within the <br />permit area. <br />The area affected is estimated to be 41 acres inclusive <br />of portal installation and surface plant, sedimentation <br />ponds, waste dumps and access roads and parking. In any one <br />period after underground coal extraction commences, approxi- <br />• mately two to three acres will be actively mined. The area <br />of underground personal activity will increase as the drifts <br />are driven through the coal areas. <br />6. Personal Injury and Property Damage Insurance Information. <br />Attached hereto as Exhibit "D" is a Certificate of Public <br />Liability Insurance pertaining to the permit area providing <br />coverage for personal injury and property damage in compliance <br />with Rule 2.03.9. <br />7. Identification of Other Licenses and Permits. <br />A. Applicant will require an NPDES permit from the <br />Colorado Department of Health for the discharge of water from <br />the permit premises. Applicant currently holds an NPDES <br />Permit. <br />B. Applicant currently holds a permit from the Board of <br />County Commissioners of LaPlata County issued pursuant to <br />Section 24-65-.1-101, et seq., C.R.S. 1973, and the admini- <br />strative regulations and guidelines adopted by the Board of <br />County Commissioners of LaPlata County which is dated <br />February 22, 1977. The address of the Board of County <br />Commissioners is P. O. Box 1711, Durango, Colorado 81301. <br />8. Newspaper Advertisement.
