(k) Lands disposed of with lensed deposits reserved to the United <br />States. If the lancls embraced herein have been or shall hereafter be <br />disposed of under laws reserving to the United States the leased deposits <br />therein, to comply with all conditions as are or m~qy hereafter be provided <br />`by the laws and regulations reserving such deposits. <br />(1) Operation:; mini and reclamation of lands es freedom of <br />~u•chnse. To comply with the operating regulations 30 CFR Fart 231 , to <br />exercise reasonable diligence, skill, and care in the operation of the <br />property, and to carry on all operations in accordance with approved <br />methods and practices as provided in the operating regulations, having <br />due regard for the prevention of injury to life, health, or property, and <br />of waste or damage t.o arty water or mineral deposits; to comply, to the <br />same extent as if this operations under this lease were surface mining, <br />with the applicable provisions of the surface a lorntion, mining and <br />reclamation of lands regulations (43 CFR Part 23~ to avoid, minimize, or <br />correct damage to ttie environment--land, water, and air--and to ovoid, <br />minimize, or correct• hazards to the public health and safety; to pay all <br />wages due miners and employees both above and below ground, at least <br />twice each month in lawful money of the United States; to accord all <br />miners and employees complete freedom of purchase; to restrict the <br />workday to not exceeding 8 hours in arty one d4y for underground workers, <br />except in cases of emergency; to employ no boy under the age of 16 and <br />• no girl or woman, without regard to age, in arty mine below the surface, <br />unless the laws of the State othenaise provide, in which case the State <br />laws control. <br />(m) Taxes. To pay, when due, all taxes lawfully assessed and levied <br />under the laws of the State or the United States upon improvements, output <br />of mines, or other rights, property, or assets of the lessee. <br />(n) Overriding royalties. Not to create, by assignment or othexvise, <br />an overriding royalty in excess of 1 percent of the gross value of the out- <br />put at the point of shipment to market unless the owner of that interest <br />files his agreement in writing that such interest is subject to reduction <br />or suspension to a total of not less than 1 percent of such gross value, <br />whenever, in the interest of conservation, it appears necessary to do so <br />in order to (1) prevent pranature abandonment or (2) make possible the <br />economic mining of marginal or low-grade deposits on the leased lands or <br />any part thereof. <br />(o) Delivery of premises in case of forfeiture. In case of forfeiture <br />of this lease to deliver up to the lessor in good order and condition, in <br />accordance with the applicable regulations, and subject to the provisions <br />of Sec. 6 hereof, the land leased, including permanent improvements and <br />other property, whether fixtures or personalty, and all undergroun3 timber- <br />ing end such other supports an3 structures es are necessary for the <br />preserr-ation of any mines, other underground development works, or deposits. <br />• o <br />d <br />
