6.4.13 EXHIBIT M -Other Permits and Licenses <br />42. The Applicant has stated in the August 19, 2005 engineering report from Lyman Henn, Inc. that <br />groundwater will probably be exposed by the mining operations. The Applicant has also stated that they <br />may need a Temporary Substitute Supply Plan (TSSP) and/or Plan of Augmentation, to account for <br />groundwater that maybe depleted due to exposure of groundwater moisture on the quarry face. In <br />response, the Division requests that the Applicant provide a commitment to either a) Submit written <br />evidence of necessary Office of the State Engineer (OSE) approval for exposure of groundwater prior to <br />initiation of quarrying activities , or b) Backfill exposed groundwater to a depth of at least two (2) feet <br />above the groundwater surface within 24 hours of intercepting the groundwater surface during quarrying <br />activities. Please respond. <br />Once again, we will look forward to your response to Division adequacy concerns on or before September <br />14, 2005 to allow adequate time for review before the September 16, 2005 recommended decision date. <br />Please be sure to submit two (2} copies of all documents. Rule 1.8.1 states that changes and additions to <br />the permit application must be filed with the Division and the County Clerk and Recorder.
