The <br />information you provided in person on that date supplied the Division satisfied many of the adequacy requirements. <br />At this time, it appears that there are only two remaining requirements. <br />If the operator has performed a fire assay test, please provide the results of this test to the Division. Otherwise, <br />please provide the Division with the results of a simple acid-base accounting test to ensure that both the ore body <br />and ore waste are not acid fomring. <br />In addition, please provide a written commitment to submit results of field assay testing, as well as any other field <br />test results, to indicate that the nature of both the ore body and ore waste continue to be non-acid forming. These test <br />results are to be submitted to the Division annually with the required annual fee and report. <br />This information is required to address the remaining items in order for the Division to make an approval or <br />denial decision. If you feel more lima is needed to complete your reply, the Division can grant an extension to the <br />decision date. This will be done upon receipt of a written waiver of your right to a decision by May 4, 2007 and <br />request for additional time.
