DATE: March 22, 2003 <br />TO: Kate Pickford <br />FROM: Allen Sorenson <br />RE: Interim Resolution of Potential for Floodp[ain Impacts Related to the Mining of the <br />Bernhardt Resource Gravel Pit, Hall-Irwin Corporation, File No. M-2002-120 <br />On Thursday, March 2Q 2003 I had a telephone discussion with Barb Brunk of RMC Tetra Tech about <br />the relationship of [he 100-year floodplain to the proposed mining at the Bernhardt Resource site. <br />Based on this discussion, the Division and the Applicant concur that the westernmost proposed mining <br />pod can be excavated in accordance with the mining plan without adverse floodplain impacts. We <br />further concur that rigorous evaluation of the potential for flood impacts must be completed, and <br />possibly flood conveyance structures designed and installed, prior to mining in the floodplain of the <br />other proposed mining pods. As a result of these discussions, it has been determined that the <br />floodplain issues need not impede a recommendation to approve the Bernhardt Pit application if the <br />following enforceable permit language is committed to by the Applicant or stipulated by the Division. <br />Mining within the 100-hundred year floodplain of the westernmost proposed mining pod can <br />proceed upon issuance of a reclamation permit for the Bernhardt Resource Pit.
