Response to Adequacy Review. <br />Dear Erica: <br />In response to your "Adequacy Review" letter dated June 11, <br />1999, I will address the issues in order. <br />1). Proof of Publication of public notice attached; <br />2). Moffat County acknowledges that the Colorado Department of <br />Public Health has jurisdiction over Storm Water Discharges <br />into the "Waters of the United States". We have addressed <br />these issues many times in the past. This facility does not <br />require a Storm Water Discharge Permit because local drainage <br />water will be diverted to low portions of the excavation <br />area for evaporation, and because upland surface water runoff <br />will be diverted away from the mine with berms and ditches <br />as needed. (See Exhibit E #10 & #12, also see Exhibit 'F' <br />and Exhibit 'G'). <br />3). Moffat County prefers to seed the disturbed areas in late <br />fall. However, the road department has major activities at <br />the landfill, in public works projects, in road construction <br />and maintenance, and in the production of gravel. We will <br />seed the Little Snake Pit #26 when our resources are <br />available for reclamation projects - we cannot exclude any <br />season even if the prospects for re-vegetation success are <br />slight. Our expected seeding times are 365 days per year. <br />4). As we discussed on the telephone on June 3, 1999, Note #4 on <br />Exhibit 'F' needs clarification. Moffat County will make a <br />temporary detour of County Road #26 - WITHIN THE AFFECTED <br />MINE AREA - to accommodate the gravel mining operation. The <br />road will be replaced within its original right-of-way during <br />reclamation of this pit. This activity does not create <br />additional "affected area", or require amendments to our <br />application. <br />Enclosed please find the standards that Moffat County will <br />apply to the existing County Road #26 for access to the mine and <br />for the purpose of reclamation within the affected area. (See <br />attached letter to BLM dated 10/22/98) <br />~ ~; ~. <br />
