The Applicant has stated in the August 19, 2005 engineering report from Lyman Henn, lnc. <br />that groundwater will probably be exposed by the mining operations. The Applicant has also <br />stated that they may need a Temporary Substitute Supply Plan (TSSP) and/or Plan of <br />Augmentation, to account for groundwater that may be depleted due to exposure of groundwater <br />moisture on the quarry face. In response, the Division requests that the Applicant provide a <br />commitment to either a) Submit written evidence of necessary Office of the State Engineer (OSE) <br />approval for exposure of groundwater prior to initiation of quarrying activities, or b) BackfilI <br />exposed groundwater to a depth of at least two (2) feet above the groundwater surface within 24 <br />hours of intercepting the groundwater surface during quarrying activities. Please respond. <br />The Applicant will comply with state law regarding impacts to groundwater. The <br />applicant therefore commits to either supply evidence of an approval from the <br />Office of the State Engineer or backfill exposed groundwater within 24 hours, to a <br />depth of at least two (2) feet, where quarry activities have intercepted the <br />groundwater surface. <br />Please contact Alex Schatz or Paul Gesso at our office with any questions <br />regarding this letter and the enclosed supplementary materials.
