De;,!. of idatural Resol~rces <br />Re: Your File N81-22 <br />GL Gravel Pit <br />Dear bSr. Lucas <br />Our firm reprE~sents <br />applicant for a sand and <br />number above referenced. <br />Glass Livestock Company, Inc., the <br />gravel permit under the application <br />Your letter, :is well as a photocopy of the memorandum from <br />the Division of Water Resources, have been given to me for reply. <br />I find nothini; in the statutes or in the rules and regula- <br />tions of the Mined Land Reclamation which gives the Division <br />of Water Resources any jurisdiction over the pending application. <br />I also find the attempt to label a gravel pit as a well <br />to be totally unfounded either in law or by statute. <br />If in fact thl~ Division of Water Resources attempts to <br />impose their jurisliiction that will be a separate problem to <br />be litigated in ou:c District Court or in the Water Court for <br />this Division. <br />If I am mistaken and there is some jurisdiction over <br />this matter by the Division of Water Resources, I would be <br />pleased to have you inform me concerning those possible areas. <br />Otherwise the applicant requests that yo proceed to process <br />its application on its merits pursuant o the statutes and <br />your rules and regulations which axe p icable thereto. <br />Your~'~fery truly <br />v <br />e E.
