Ltsnectiont and Right to Entry <br />The permittee shall allow the Director of the Water Qttality Control Division and/or the authorized representative, upon <br />the presentation of credentials: <br />a) To inter upon the parmittee'a premieea where a regu4tad facility or activity is located or in which .ny records ere <br />required W be kept under the terms and conditions of this permit; <br />b) At reasonable times to have access to and copy any records required to be kept under the terms and conditions of <br />this permit and to inspect any monitoring oquipmmt or monitoring method required in the permit and <br />c) To inter ttpon the permittx's premises in a reasonable m ~~~* and at a reasonable time to inspect and/or <br />investigate, gay actual, suspxtad, or potential source of water pollution, ar to ascertain compliance or non <br />wmpliance with the Colorado Water Quality Control Act or any other applicable state of federal statute or <br />reguLttion or any order promulgated by the Division. The investigation may include, but is not limited to, the <br />following: sampling of my discharge and/or protege waters, the taking of phomgraphs, interviewing of any person <br />Laving k>mwledge related to the discharge permit or alleged vioLrtim, access to any and all facilities or areas within <br />the permittae's prm»sea that may Lave any affect on the discharge, permit, or alleged violation. <br />d) The Division shall split sampLx taken by the Division during any investigation with the permittce if requested to do <br />so by the permittee. <br />2. Duty to Provide information <br />The permittee shall furnish to the Division, within a reasonable time, any information which the Division may request to <br />determine whether cause exists for modifying, revoking and reissuing, or terminating this permit, or to determine <br />compliance wiW this permit. The permittee shall also furnish to the Division, upon request, copies of records required <br />to be kept by this permit. <br />3. Transfer of Owntsshi~ or Control <br />A permit may be transferred to a new permittee ody upon the completion of the following: <br />a) The cunmt permittee notifies the Division is writing 30 days in advance of the proposed transfer date; and <br />b) The notice includes ^ written agreement between the existing and new permittees containing a specific date for <br />transfer of permit responsibility, coverage and liability between them; and <br />c) Fae requiremmta of the State Discharge Permit System Regulations, Section 6.16.0 have been met. <br />4. Availability of Reports <br />Except for data determined to ba confidential order Section 308 of the Federal Clean Water Act and Regulations for the <br />State Discharge Permit System 5 CCR 1002-2, 6.6.4 (2), all reports Prepared in accordance with the terms of this permit <br />stall be available for public iospectian u the offices of dre Water Quality Control Division end the Environmental <br />Protection Agency. <br />As required by dre Federal Clean Water Act, effluent data shall not be considered confidential. Knowingly making <br />false statement on any such report may result in the imposition of criminal penalties as provided for in Section 309 of the <br />Federal Clean Water Act, end Section 25-8110 C.R.S. <br />woar win <br />
