PART I <br />Page xii <br />Permit No. CO-0000396 <br />C. DEFINITIONS OF TERMS <br />12. 'Visual' observation is observing the discharge to check for the presence of a visible sheen or floating oil. <br />l3. 'Water Quality Control Division' or 'Division' means the state Water Quality Control Division es established in 25-8- <br />101 et al. <br />D. REPORTING <br />1. Si¢natorv Rettuirements <br />All reports roquired for submittal shall be signed and certified for aceuracy by the permittce in accord with the following <br />criteria: <br />a) In the case of rbrporations, by a principal executive officer of at least the level of vice-president or his or her duly <br />authorized representative, if such representative is responsible for the overall operation of the facility from which the <br />discharge described in the form originates; <br />b) In the ~ of a paAaership, by a general partner; <br />c) In the case of a sole proprietorship, by the proprietor, <br />d) In the case of a municipal, state, or other public facility, by either a principal executive officer, ranking elected <br />official, or other duly authorized employx. <br />E. SPECIAL REQUIREMENTS <br />1. Materials Containment Plan <br />Pursuant to Sxtioas 6.9.3 (S) and (6)(b) of the Regulations for the State Discharge Permit System, the permittee is <br />required to submit a Materials Containment Plan. Such a plan was previously submitted to the Division. An updatz of <br />the plea shall be submitted to the Permits and Enforcement Section, Water Quality Control Division within ninety (90) <br />days after the effective date of this permit and must be implemented. The update of the plan shall include changes in the <br />information and procedures for the prevention aad containment of spills of materials used, processed or stored et thz <br />Facility which if spilled would have a reasonable probability of having a visible or otherwise detrimental impact on <br />waters of the State 1/ 2/. The updated plan shall include, but not necessarily be limited lo: <br />a) An updated history of the spills which have occurred in the three (3) years preceding the effective date of this <br />permit. The history shall include a discussion on the cause of the spills and a the preventative measures designed to <br />eliminate them from reoccurring; <br />b) An update of the reporting system which will be used fo notify, at a minimum, responsible facility management, the <br />Water Quality Control Division, the Environmental Protection Agency, downstream water users within 5 miles <br />downstream of the facility, end local health officials; <br />c) A description of any changes in Ute preventative facilities (including overall facility plot) which prevent, contain, or <br />treat spills and unplanned discharges; <br />d) A current list which includes the volumes or quantities of all materials used, processed, or stored at the facility <br />which represent a potential spill threat to surface waters. The lorstion of stored material shall be indicated on the <br />facility plot submitted for item c; <br />e) An implementation schedule for additional facilities which might be required in item c, but which are not yet <br />operational; <br />IKI)IIP a9N) <br />
