io <br /> <br />,. <br />LICENSE AGREEMENT <br />THIS LICENSE, executed this qty- day of March <br />19 70 by WESTERN SLOPE GAS COMPANY, a Colorado corporation, <br />hereinafter called "Licensor" to H-G Coal Company; a Delaware <br />general partnership, hereinafter called "Licensee"; <br />WITNESSETH: <br />WHEREAS, the Licensor owns certain riy hts of way <br />and easements for natural gas transmission pipelines over and <br />across the following described lands: <br />Beginning at a point on the west line of the <br />NE/4[JE/4 of Section 15, T6N, RBBW, which point <br />bears South 1 deg. 25' E 75 feet from the NW <br />corner of said NE/4NE/4 of Section 15, thence <br />South 89 deg. 31' E 1332.5 feet to a point on <br />the East line of Section 15 which point bears <br />South 1 deg. 24' E 75.0 feet from the NE cor- <br />ner of said Section 15. <br />Said description being the centerline of a <br />R.O.w. 50 feet in width and 00.7 cods in <br />length. <br />WHEREAS, the Licensee desires to route an industrial <br />railroad spur track hereinafter called the licensed facility <br />over and across portions of said easements and desires to <br />obtain permission therefoc; <br />IT IS, THEREFORE, agreed as follows: <br />(1) In consideration of the payment of One Dollar <br />(51.00) and other valuable consideration, the receipt whereof <br />is hereby acknowledged, Licensor hereby grants to Licensee, <br />its successors and assigns, with respect to such title and <br />interest as Licensor may have in the premises, and upon the <br />terms and conditions hereinafter stated, the permission and <br />right to lay, maintain, operate, repair, inspect, remove and <br />replace the licensed facility in, across and over certain <br />easements owned by Licensor, said installation and construc- <br />tion to be located as shown on the sketch attached hereto as <br />Exhibit A.and made a part hereof by reference. <br />(2) The Licensor reserves the right to grant <br />to others the use of the premises Eor any purposes, provided <br />_ that same shall not interfere unreasonably with the licensed <br />~ facility herein authorized and Licensor has obtained the prior <br />approval of the fee owner of the premises. <br />(3) Licensee shall not do or permit to be done <br />any blasting above, underneath or within 750 feet of the <br />transmission pipeline of Licensor without first having received <br />written permission from the office of the Engineering Manager <br />of Licensor. .Licensee ~s hall give Licensor a minimum of forty <br />eight (48) hours prior notice Of any said blasting and said <br />office may have present a representative at the blasting who <br />may direct the blasting Eor the protection or safety of <br />Licensor's facilities in the area. If after giving notice <br />as herein provided, Licensor does not have its representative <br />present at the blasting, Licensee may proceed with its <br />• blasting. <br />
